Here's an amusing story about a faggot/queer HIVer who's trying to use
his sexual orientation and HIV antibody status as an excuse to take
time off work and sue his employer.

My favourite part of the article this: "The HIV-positive plaintiff

discrimination, disability discrimination because he is gay,
harassment and retaliation."

A Costco employee on leave from the Inglewood store deserves more than
$850,000 for being disparaged by fellow workers in a video and also
demoted, all because he is gay, an attorney told a civil jury
Wednesday.

“Mr. [Juan I.] Valera was treated different simply because of his
sexual orientation,’’ attorney Leo J. Terrell said.

But Costco lawyer Tara L. Wilcox said Valera’s case has plenty of
allegations that do not add up or make sense.

“The three people involved in the video didn’t even know he was gay,’’
Wilcox said in her closing argument.

The HIV-positive plaintiff filed the lawsuit in October 2006, alleging
sexual orientation discrimination, disability discrimination because
he is gay, harassment and retaliation.

After more than 20 years at Costco, everything changed when a new
general manager, John Weaver, arrived at the Inglewood location in
2005 and casually used the word “queers’’ in a statement heard by
Valera, Terrell said.

Valera took a leave of absence because of the stress, and when he
returned asked the assistant general manager to protect him from
further insensitive remarks, Terrell said. A day later, his work load
was doubled and his pay was cut, according to Terrell.

The 45-year-old plaintiff was forced to take a second continued stress
leave and was demoted to cashier, Terrell said. He also eventually was
stripped of his benefits, according to his attorney.

Here in California it is illegal to discriminate on basis of sexual
orientation, but I used to live in Texas which has no such anti-
discrimination law, nor do many other U.S. states. Federal law
prohibits discrimination against people with the HIV virus, so it
winds up being legal to discriminate against a gay person unless he
has AIDS. A Texas employer can refuse to hire me or can fire me for
being a healthy gay man, but the moment I catch AIDS he is required to
employ me.
